1. Acceptance of Terms

Welcome to Push Challenge! These Terms of Service ("Terms") are a legal agreement between you and Ojutu Global LLC ("Company," "we," "our," or "us") governing your use of the Push Challenge mobile application (the "App").

By creating an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Push Challenge is a fitness tracking and social motivation app that allows users to:

• Track workout goals and progress
• Connect with friends and participate in challenges
• View personal statistics, streaks, and achievements
• Compete on leaderboards
• Receive reminders and notifications about fitness goals

The App is provided free of charge.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the App.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. User Accounts

To access certain features, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials.

You agree to notify us immediately of any unauthorized use of your account and be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent or abusive activity, or prolonged inactivity. You may delete your account at any time through the app settings.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful, offensive, or inappropriate content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Use automated systems (bots) to access the App
• Attempt to gain unauthorized access to the App or its systems
• Interfere with the proper functioning of the App
• Reverse engineer, decompile, or disassemble the App

You retain ownership of any content you submit to the App. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the App.

6. Workout Data and Accuracy

All workout data entered into the App is self-reported by users. We do not verify the accuracy of user-reported workout counts or achievements.

Important: The App is for fitness tracking purposes only and does not provide medical advice. The App should not be used as a substitute for professional medical advice, to diagnose or treat any medical condition, or as a basis for medical decisions. Consult with a healthcare professional before beginning any exercise program.

You acknowledge that physical exercise involves inherent risks. You assume all risks associated with your use of the App and any exercise activities you perform.

7. Social Features

You may connect with other users as friends, create or join challenges, and appear on public leaderboards. By using the App, you agree that your display name, avatar, and ranking may appear on leaderboards visible to all users.

You are responsible for managing your privacy settings and understanding what information is shared with other users.

8. Intellectual Property

The App, including its design, features, graphics, text, and all intellectual property rights therein, is owned by Ojutu Global LLC and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

"Push Challenge" and associated logos are trademarks of Ojutu Global LLC. You may not use our trademarks without our prior written consent.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the App will meet your requirements, be available at all times, be free of errors, or be free of viruses or harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100
• WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, PHYSICAL INJURIES RELATED TO EXERCISE ACTIVITIES, LOSS OF DATA, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and sending you a notification.

Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

You may stop using the App and delete your account at any time through the app settings.

We may terminate or suspend your access immediately, without notice, for violation of these Terms, illegal activity, or discontinuation of the App.

Upon termination, your right to use the App ceases immediately and your data may be deleted subject to our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to arbitrate disputes on an individual basis only.
